The terms of this agreement constitute a prerequisite for your use of the products and/or services provided by Foley Home Group and its derivative services. You should carefully read and fully understand this agreement before using Foley Home Group's products and/or services. Your use of Foley Home Group's products and/or services (including downloading, installing, launching, browsing, registering, logging in, using, etc.) indicates your agreement to all the terms of this agreement; If you are unwilling to accept any of the terms of this agreement, you shall not use or immediately cease to use the products and/or services provided by Folell Home Group. The relevant operation tips, Q&A guides, usage assistance, or other rules and procedures displayed to you by Foley Home Group on its platform constitute a part of the relevant rules for your use of Foley Home Group's products and/or services, and have the same legal effect as this agreement. 1.2 After you accept this agreement, this agreement may be modified due to changes in national policies, products and/or services, and the environment for fulfilling this agreement. The modified agreement will be published in the appropriate location on the Foley Home Group platform. If you continue to use the products and/or services of Folell Home Group after the update of this agreement, it means that you have fully read, understood, and accepted the updated agreement and are willing to be bound by the updated agreement. 1.3 The term "user" referred to in this agreement includes registered users and unregistered users. Any user who has not registered for the products and/or services of Foley Home Group shall automatically become a "non registered user" of Foley Home Group upon downloading or installing Foley Home Group's products and/or using Foley Home Group's services, and shall comply with all other terms except for the user registration provisions of this agreement. 1.4 The term "Foley Home Group" referred to in this agreement refers to Tianjin Foley Home Group Co., Ltd. 1.5 Foley Home Group needs to remind you that due to the wide range of products and services offered by Foley Home Group, the content of the products and services provided to you may also vary. This agreement is a general user service clause uniformly applicable to Foley Home Group. For certain specific products/services of Foley Home Group, Foley Home Group will also develop specific user service agreements to more specifically explain the service content, service rules, and other content of Foley Home Group to you. You should fully read and agree to the entire content of the specific user service agreement before using the specific product/service. 1.6 If you are a minor, please read this agreement with your guardian and pay special attention to the minor clause. The exercise and performance of the rights and obligations under this agreement by minors shall be deemed to have been recognized by their guardians. 1.7 Foley Home Group hereby kindly reminds you that the clauses in this agreement that may have a significant impact on your rights and interests have been highlighted in bold font. Please pay attention to them carefully. At the same time, both parties agree that the aforementioned terms do not fall under the provisions of Article 40 of the Contract Law, which exempts the other party from liability, increases the other party's liability, and excludes the other party's main rights. Both you and the Foley Home Group acknowledge the legality and validity of the aforementioned terms, and you will not claim that the terms in the agreement are illegal or invalid on the grounds that Foley Home Group has not fulfilled its obligations such as reasonable prompts. 1.8 If you have any doubts or other related matters while reading this agreement, FLEER Home Group provides you with multiple feedback channels. Please refer to the "Contact Information" section for details, and FLEER Home Group will provide you with answers as soon as possible. 2、 Service Description 2.1 The products and/or services that Folell Home Group wants users to provide, including but not limited to: 2.1.1 The company website and any other website directly owned or operated by the Foley Home Group (also known as the "Foley Home Group website"); 2.1.2 The clients directly owned or operated by Foley Home Group include but are not limited to all terminal client products such as tablets and mobile phones (also known as "Foley Home Group clients"); 2.1.3 Other products and/or services provided by Foley Home Group. (The products and services listed above are collectively referred to as "products and/or services of Foley Home Group", and the platforms on which these products and services are located are collectively referred to as "Foley Home Group's platforms") 2.2 This agreement applies to all products and/or services of Foley Home Group, including but not limited to software, websites, services (including off-site services such as Foley Home Group advertising services and plugins for "applying or sharing services through Foley Home Group"), as well as related product or service functions, including but not limited to mobile terminals. 2.3 The products and/or services of Foley Home Group are limited to users' use on Foley Home Group's platform only. Any act of maliciously cracking or other illegal means to separate Foley Home Group's products and/or services from Foley Home Group's platform is not considered as Foley Home Group's products and services as stipulated in this agreement. All legal consequences arising from this shall be the responsibility of the perpetrator, and Foley Home Group will hold the perpetrator legally accountable in accordance with the law. 2.4 The only legal way for users to download, install, launch, browse, register, log in, and use the services of Foley Home Group is through the official announcement of Foley Home Group. Any products and services obtained by users through any other channels, channels, or methods without the legal authorization of Foley Home Group (including but not limited to account, client download, and other services) are illegal, and Foley Home Group does not recognize their effectiveness. Once discovered, Foley Home Group has the right to immediately delete, cancel, reset, or block the account. Any adverse consequences resulting from this shall be borne by the user. 2.5 Users have the right to use their legally obtained building materials cloud purchase app accounts within the scope authorized by Foley Home Group. However, users confirm that they only have the right to use the above-mentioned services and products. The ownership and intellectual property rights of the above-mentioned services, products, and their derivatives belong to Foley Home Group or have legal authorization (except for the ownership of physical products obtained through legal channels, personal property belonging to users under the account, and other rights and interests specified by Foley Home Group). Folell Home Group has the right to revoke the above-mentioned usage rights within the maximum scope permitted by law and based on actual circumstances, without notifying the user or obtaining their consent. 2.6 Foley Home Group has the right to notify users in advance (including but not limited to pop-up page announcements, official website announcements of Foley Home Group) to modify, replace, upgrade any products and/or services provided by Foley Home Group and/or personnel and software related to the above-mentioned products and/or services. If the user does not agree to any modification, replacement, or upgrade of products and/or services provided by Foley Home Group and/or related software, please refuse, stop, or cancel directly. Otherwise, it shall be deemed that the user agrees to any modification, replacement, or upgrade of products and/or services provided by Foley Home Group and/or related software, and the aforementioned modification, replacement, or upgrade shall not affect the validity of this agreement. 3、 Service Usage Rules 3.1 Users must provide complete, truthful, accurate, legal, valid, and up-to-date personal information to Folell Home Group when applying for registration and use of Folell Home Group products and/or services. If the above information changes, users should make timely changes. And ensure that the above information is the true information of the user, and shall not falsely use the identity of others or use others' email, mobile phone number, etc. to register a building materials cloud purchase app account. If there are any account disputes or related issues caused by inaccurate or untimely registration information, or fraudulent behavior, Foley Home Group shall not be held responsible. At the same time, Foley Home Group has the right to temporarily or permanently suspend this account based on the actual situation. 3.2 Users can only register as registered users of the Building Materials Cloud Shopping app through the official channels of the Foley Home Group. Any building materials cloud purchase app account information obtained through non official channels of the Foley Home Group (including but not limited to purchasing, renting, borrowing, sharing, and other methods of obtaining building materials cloud purchase app account information, as well as registration accounts obtained through malicious use or destruction of the Foley Home Group registration system), the Foley Home Group does not guarantee its legality and normal usability. If the account is suspended, cancelled, or revoked as a result, the user shall bear full responsibility on their own. 3.3 Users should register an account through real identity information authentication, and the account name, avatar, and profile submitted by the user must not contain any illegal or harmful information. Foley Home Group has the right to review the above information and the user's real identity. If the above situation exists, Foley Home Group has the right to refuse registration, or if there is illegal or harmful information in the account avatar, profile, and other registration information, Foley Home Group has the right to take unilateral measures such as correction, removal, temporary suspension, permanent suspension, cancellation of registration, and retrieval without notice. 3.4 Users shall not maliciously register building materials cloud purchase app accounts through any means (including but not limited to using invalid unverified email addresses, invalid phone numbers, using other people's identities, etc.), or use building materials cloud purchase app accounts to engage in illegal activities, disrupt, harass, deceive other users, and other behaviors that violate this agreement. Foley Home Group has the right to permanently suspend, cancel registration, revoke and other measures for the above accounts. Any losses caused by this shall be borne by the users themselves. At the same time, Foley Home Group has the right to transfer the above-mentioned actions to the competent department for handling. 3.5 The ownership of the Building Materials Cloud Purchase app account belongs to the Folell Home Group, and users only have limited usage rights for the Building Materials Cloud Purchase app account. Users are responsible for all actions taken under the account they have the right to use. Users should properly keep their account and password, and are not allowed to transfer, lend, rent, sell, or share their Building Materials Cloud Purchase app account with others for use. Otherwise, Foley Home Group has the right to temporarily or permanently suspend this account based on the actual situation. When the user's account or password is used without authorization, the user should immediately notify Foley Home Group. Otherwise, unauthorized use will be deemed as the user's own behavior. In order to ensure the security of users' accounts, Folell Home Group may regularly or irregularly use different methods to verify users' identities, including but not limited to requiring verification codes, short message verification, email authentication, etc. If the user is unable to complete the verification or refuses to verify, Foley Home Group may reasonably suspect that the user's account has been abnormal or stolen, and suspend the provision of products and/or services to the user and/or take further measures. 3.6 In case of loss of user account information due to reasons not related to the Foley Home Group, if the user needs to retrieve it, they must provide corresponding information and proof in accordance with the official account retrieval process published by Foley Home Group, and ensure the legality, authenticity, and validity of the provided information and proof documents. If the provided materials are untrue or do not meet the requirements, they may not pass the security verification of the Foley Home Group account, which may result in the failure of account retrieval, and the corresponding risks and losses shall be borne by the user. 3.7 In order to ensure the provision of better services to more users, the user agrees that the Foley Home Group has the right to permanently cancel or revoke any Building Materials Cloud Purchase App account that has not been used for six consecutive months, and any Building Materials Cloud Purchase App account that has been obtained through illegal means and violates this user agreement. 3.8 The user agrees that the Foley Home Group may place commercial advertisements or any other type of commercial information in various ways during the provision of products and/or services (including but not limited to placing advertisements on any location of the Foley Home Group platform and placing advertisements in the content uploaded or broadcasted by the user). The user agrees that Foley Home Group may send product promotions or other related commercial information to the user through email or other means after obtaining the user's consent. 3.9 The user acknowledges and agrees that, due to issues with broadband and network connectivity, there may be a need for prolonged buffering, buffering, or other similar situations during the provision of products and services by Foley Home Group. Such situations are not the fault of Foley Home Group, and Foley Home Group shall not be liable to the user for such situations. In order to reduce or even avoid the occurrence of the above situations and further enhance the user's service experience, the user confirms that the Foley Home Group can adopt a series of technical measures to optimize its products and services. 3.10 The user knows and agrees that the products and services provided by Fryer Home Furnishing Group can only be used after being connected to the Internet. Therefore, the user shall bear the costs of upstream and downstream network communication traffic generated in the process of using the products and services, and the network operator will charge the above costs. Users can also make relevant settings for network usage information through the product's settings page. 3.11 When using the products and/or services of Fryer Home Furnishing Group, users should abide by the constitutional laws, including but not limited to the Law of the People's Republic of China on Guarding State Secrets, the Copyright Law of the People's Republic of China, the Regulations of the People's Republic of China on the Security Protection of Computer Information Systems, the Regulations on the Protection of Computer Software, the Administrative Provisions on Internet Electronic Announcement Services, the Regulations on the Protection of the Right to Disseminate Information Networks, the Network Security Law and other laws and regulations on computers and the Internet; We should abide by public order, respect social morality, not endanger network security, and not use the internet to engage in activities that endanger national security, honor, and interests, incite subversion of state power, overthrow the socialist system, incite separatism, undermine national unity, promote terrorism and extremism, promote ethnic hatred and discrimination, spread violent and obscene information, fabricate and spread false information to disrupt economic and social order, and infringe on the reputation, privacy, intellectual property rights, and other legitimate rights and interests of others. In any case, once the Foley Home Group reasonably believes that the user has engaged in the above-mentioned behavior, it may terminate the provision of products and/or services to the user at any time without prior notice. 3.12 Users are prohibited from using the products and services provided by Foley Home Group to engage in the following behaviors: 3.12.1 Produce, upload, copy, transmit, and disseminate any content that opposes the basic principles established by the Constitution, endangers national security, leaks state secrets, subverts state power, undermines national unity, damages national honor and interests, incites ethnic hatred, ethnic discrimination, undermines national unity, undermines national religious policies, promotes cults and feudal superstitions, obscenity, pornography, gambling, violence, murder, terrorism, or instigates crime, insults or slanders others, infringes on the legitimate rights and interests of others, or other content prohibited by laws and administrative regulations, including but not limited to information, materials, text, software, music, photos, graphics, or other materials that are offensive; 3.12.2 Endangering minors in any way; 3.12.3 Impersonate any person or organization related to it; 3.12.4 Falsifying titles or manipulating identification information in other ways to make people mistakenly believe that the content is transmitted by the Foley Home Group; 3.12.5 Upload, post, email or otherwise transmit unauthorized content (such as internal information, confidential information); 3.12.6 Upload, post, email or otherwise transmit any content that infringes on anyone's patents, trademarks, copyrights, trade secrets or other exclusive rights; 3.12.7 Upload, post, email or otherwise transmit advertising letters, promotional materials, "junk mail", etc. Except for dedicated areas used for the aforementioned purposes; 3.12.8 Tracking or harassing others in other ways, illegally invading others' networks, interfering with their normal network functions, stealing network data, and other behaviors that endanger network security; 3.12.9 The act of providing programs or tools specifically designed for intrusion into networks, interference with normal network functions, and theft of network data that pose a threat to network security to others, or knowingly providing technical support, advertising promotion, payment settlement, and other assistance to others engaged in activities that pose a threat to network security; 3.12.10 Utilize the services provided by Foley Home Group to establish websites and communication groups for committing fraud, teaching criminal methods, producing or selling prohibited or controlled items, and other illegal and criminal activities, or use Foley Home Group's network to publish information related to committing fraud, producing or selling prohibited or controlled items, and other illegal and criminal activities; 3.12.11 Upload, post, email or otherwise transmit software viruses or other computer code, files and program materials that interfere with, damage or restrict the functionality of any computer software, hardware or communication equipment; 3.12.12 Interfere with or disrupt servers and networks connected to the services of Foley Home Group; 3.12.13 Intentionally or unintentionally violating any relevant Chinese laws, regulations, rules, ordinances, or other legally binding norms; 3.12.14 Users shall ensure that their uploaded content does not violate the relevant provisions of SARFT, including but not limited to the Administrative Provisions on Internet Audio visual Program Services (SARFT 56), etc. The uploaded content shall comply with laws, administrative regulations and departmental rules, and the uploaded content shall not contain the following content: （1） Opposing the basic principles established by the Constitution; （2） Endangering national unity, sovereignty, and territorial integrity; （3） Disclosing state secrets, endangering national security, or damaging national honor and interests; （4） Those who incite ethnic hatred, ethnic discrimination, undermine ethnic unity, or infringe upon ethnic customs and habits; （5） Promoting cults and superstitions; （6） Disrupting social order and disrupting social stability; （7） Inducing minors to commit illegal crimes and exaggerating violent, pornographic, gambling, or terrorist activities; （8） Insulting or slandering others, infringing upon the legitimate rights and interests of citizens' personal privacy and others; （9） Endangering social morality and damaging the excellent cultural traditions of the nation; （10） Other content prohibited by laws, administrative regulations, and national provisions. If the uploaded content provided by the user contains information or content that violates policies, laws, and regulations, the user shall directly bear all adverse consequences resulting from the upload. If any adverse consequences are caused to the Folell Home Group as a result, the user shall be responsible for eliminating the impact and compensating for all losses caused thereby. 3.12.15 Without the prior explicit written permission of Folell Home Group, obtain the services, content, and data of the platform in any way (including but not limited to robot software, spider software, crawler software, and any other automatic programs, scripts, software) and for any reason by oneself or by entrusting others to assist others; 3.12.16 Obtaining and using products and/or services of Foley Home Group for oneself or others for commercial or other non personal purposes without prior explicit authorization from Foley Home Group; 3.12.17 Without explicit authorization from Foley Home Group, display all or part of Foley Home Group's service content in any public occasion, whether for a fee or free of charge (except where your actions do not constitute infringement); 3.12.18 Through improper means or in violation of the principle of good faith (such as exploiting loopholes in rules, exploiting system vulnerabilities, abusing membership status, black industries, speculation, etc. that go against the original intention of providing services/organizing events for the Folell Home Group); 3.12.19 By infringing upon the legitimate rights and interests of Tang or others; 3.12.20 Other behaviors that have not been expressly authorized or violated this agreement, laws, regulations, or regulatory policies by Foley Home Group; 3.13 If the user uses the symbols, words, pictures, audio, video and other contents produced, uploaded, released and disseminated on the platform of Freire Home Furnishing Group by using the products and/or services of Freire Home Furnishing Group, he/she shall ensure that the uploaded contents do not violate the laws, regulations and relevant normative documents of the Chinese Mainland region and the use of local laws, regulations, and do not infringe the legitimate rights and interests of any third party. Otherwise, the user shall bear all the adverse consequences caused by this, and shall also bear the liability for compensation to Freire Home Furnishing Group in case of losses. If the relevant rights holder claims their rights against the Foley Home Group due to the user's violation of this agreement, Foley Home Group has the right to directly delete, log off, or block the disputed content without notifying the uploading user. 3.14 Users shall independently and fully assume legal responsibility for the use of symbols, text, images, audio, videos, and other content produced, uploaded, published, and disseminated through the services of the Foley Home Group. This includes the obligation to compensate Foley Home Group for any losses incurred. At the same time: 3.14.1 In order to maintain the laws, regulations and relevant normative documents in Chinese Mainland and in the areas where users use Freire Group's services, protect the legitimate rights and interests of others, and maintain the reputation and safety of Freire Group, Freire Group has the right to directly delete symbols, words, pictures, audio, video and other contents that users use Freire Group's products and/or services to produce, upload, publish, and disseminate without prior notice to users; 3.14.2 Foley Home Group has the right to ban the user's ID based on the severity of the situation, permanently prohibiting them from using Foley Home Group products and/or services to create, upload, publish, and disseminate symbols, text, images, audio, video, and other content; 3.14.3 The backend records of Folell Home Group may serve as evidence of users violating laws and regulations, breaching contracts, or infringing. 3.15 Users shall ensure that they will not infringe upon the legitimate rights and interests of the Foley Home Group and others by using its services or its derivative services. It is prohibited to disrupt the normal operation of the Foley Home Group through network vulnerabilities, malicious software, or other illegal means, steal or embezzle others' accounts and assets under their accounts, etc; Prohibit other content that infringes upon the legitimate rights and interests of others. Otherwise, the Foley Home Group has the right to freeze or ban the user and account based on the severity of the situation. If it constitutes a crime, the Folell Home Group has the right to transfer it to the competent department for handling. 3.16 Users may consult with and obtain reasonable technical support for services provided by Foley Home Group, and this obligation of Foley Home Group shall not exceed its reasonable tolerance. 3.17 When users enjoy other services provided by Foley Home Group, in addition to complying with the provisions of this agreement, users still need to comply with all the agreements published by Foley Home Group on the corresponding service page that users need to comply with (the above agreement name may be adjusted in the future due to business needs, and the specific display on the platform shall prevail. The change of agreement name does not affect the effectiveness of this clause). 3.18 If you use products or services provided by third parties on the platform of Foley Home Group, in addition to complying with the provisions of this agreement, you should also comply with the service terms of the third party. 3.19 You acknowledge and agree that if you engage in any behavior that violates national laws, regulations, or regulatory policies, violates this agreement, or damages the reputation or interests of Foley Home Group, Foley Home Group has the right to independently decide to take one or more of the following measures: 3.19.1 If there is a separate clause in this agreement regarding the handling of this behavior, it shall be handled in accordance with that clause; 3.19.2 Take one or more measures to stop your behavior and its consequences without notifying you, such as deleting/blocking relevant links or content, restricting/canceling your account/account usage permissions, etc; 3.19.3 Interrupt or terminate part or all of the services without notice to you, and the relevant service fees you have paid will not be refunded or compensated in any form; 3.19.4 If your actions cause any losses to the Foley Home Group, you shall bear full liability for compensation and complete the payment of expenses within the time limit required by Foley Home Group. 4、 Upload and share user content 4.1 The user fully understands and agrees that the user upload, share, and disseminate information platform provided by Foley Home Group is only used for users to upload, share, transmit, and obtain information. The platform or any content transmitted through the platform does not reflect Foley Home Group's views or policies, and Foley Home Group shall not be held responsible for this. At the same time, users should make their own judgments on the content provided by other users on the platform and bear all risks arising from the use of such content, including risks arising from reliance on the correctness, completeness, or practicality of the content. Foley Home Group does not assume any legal responsibility for this. Folell Home Group has the right to independently determine whether to agree with users' behavior of posting and sharing information, including deleting, blocking, or disconnecting links without notifying users. Any losses incurred as a result shall be borne by the users themselves. The user acknowledges and agrees that Foley Home Group has no obligation to store the information posted or shared by the user, and the user should backup it on their own. 4.2 Unless there is evidence to the contrary, users who upload, publish, or transmit content on the platform services of Foley Home Group shall be deemed to be the copyright owner or legal authorized person of the content uploaded, published, or transmitted on the platform of Foley Home Group. Unless otherwise agreed by both parties, the act of users publicly publishing, disseminating, and sharing information and content such as images, text, audio, and video on the platform of Foley Home Group represents the user's right and agreement to permanently, irrevocably, and free grant Foley Home Group the right to exercise all copyright rights except for those belonging to the copyright owner on this information and content worldwide. Foley Home Group can exercise the rights to use, publish, disseminate, copy, modify, adapt, publish, translate, and create derivative works, disseminate, perform, and display based on the above works; The right to incorporate all or part of the information into any other form of work, media, or technology; The right to conduct commercial development on users' uploaded and published information; The right to provide information download, on-demand, data transmission, mobile video services (including but not limited to SMS, MMS, WAP, IVR, Streaming, 3G, 4G, mobile video and other wireless services), and related publicity and promotion services to users' computer terminals, mobile communication terminals (including but not limited to portable communication devices such as mobile phones and smart tablets), handheld digital audio and video playback devices, TV reception devices (analog signal reception devices, digital signal reception devices, digital TV, IPTV, playback devices with Internet access functions, etc.) through wired or wireless networks. 5、 Protection of User Personal Information 5.1 Personal information refers to various types of information recorded electronically or in other ways that can be used alone or in combination with other information to identify the identity of a specific natural person or reflect the activities of a specific natural person. If you do not agree with the content of the policy, it may cause Foley Home Group's products and/or services to malfunction or fail to achieve the service effect intended by Foley Home Group. You should immediately stop accessing/using Foley Home Group's products and/or services. Due to force majeure, hacker attacks, system instability, network interruptions, user shutdowns, communication lines, and other reasons, the products and/or services of Folell Home Group may be interrupted or unable to meet user requirements. Unless otherwise agreed in this agreement, in any case, the total compensation liability of Foley Home Group for this agreement shall not exceed the total service fee charged by Foley Home Group for providing products and/or services to you. 8.12 Regardless of whether it can be foreseen or not, and regardless of the form of the behavior, FLEER Home Furnishings Group shall be liable for any special, indirect, punitive, sudden or consequential damages or any other damages (including but not limited to loss of profits or interest, business interruption, data loss) caused by any reason. 9、 Change and interruption/termination of services 9.1 Foley Home Group has the right to temporarily or permanently change or terminate the products and/or services (or any part thereof) of the Building Materials Cloud Purchase app based on the business development of Foley Home Group. Regardless of whether the user is notified or not, Foley Home Group shall not be liable for breach of contract to the user or any third party for the change or termination of Foley Home Group's products and/or services (or any part thereof). You can apply for cancellation online, contact Foley Home Group's customer service, or cancel your account through other methods publicly announced by Foley Home Group (except as otherwise provided by laws and regulations or this agreement). Once you cancel your account, you will no longer be able to use the full range of user products provided by Foley Home Group and will automatically give up your existing rights. Unless otherwise provided by laws and regulations, after the account is cancelled, Foley Home Group will cease to provide you with all products and services of Foley Home Group.
